Catalog description
Trusts and Estates explores the law of gratuitous transfers and decedents' estates. Topics studied include intestate succession; wills; the probate process; trusts; elective share; and powers of appointment. Primary emphasis is on those aspects that relate to the planning of family property arrangements, ensuring the proper drafting and execution of wills and trusts, planning for changes in the nature of property holdings and births and deaths of beneficiaries, and understanding the fiduciary duties of trustees and executors. Throughout the course, the relevant portions of the Uniform Probate Code, the Uniform Trust Code, the New York Estates, Powers and Trusts Law, the New York Surrogate's Court Procedure Act and the relevant portions of the Restatement studied, compared, and applied to hypotheticals.
