Trademark Law explores the legal complexities and relevant policy considerations of trademark and unfair competition laws in light of 21st century technological and other contemporary realities. This course surveys the relevant domestic and international laws, treaties and policies of trademark law, with a secondary emphasis on related areas of law such as the right of publicity and misappropriation and new technologies. Topics to be covered include ownership, registration, infringement, and dilution in the context of words, phrases, symbols, slogans, product design, trade dress, fair use, and functionality. Students will explore hypothetical cases and disputes that will help develop client counseling, transactional and litigation skills and problem solving. Students will also write a paper that may be used to satisfy the AWR. The course is open to all students regardless of whether they have previously satisfied the AWR.
