One of the best ways of truly understanding a subject is by probing its most difficult or perplexing problems. This short course explores six puzzles in the law of evidence and proof, which will allow us to constantly return to the question, how can the legal system best determine the truth? Topics covered will include probabilistic evidence and so-called "naked" statistical proof; modus operandi evidence and the doctrine of chances; the problem of experts; deepfakes and authentication; and AI factfinders and algorithmic decisionmaking. Elements used in grading: Attendance, class participation, and written assignments.
