Catalog description

This course will cover fundamental concepts of IP litigation, with a specific focus on patent litigation. It will consider a variety of topics pertinent to patent infringement litigation in federal court, including the question of choice of law, pre-suit investigations, jurisdiction and venue issues, pleadings, discovery, use of experts, post-discovery strategies, claim construction (and particularly the importance of a claims chart), proving infringement (or non-infringement), proving invalidity, proving unenforceability, injunctive relief and damages, jury instructions, the appeal process, settlement agreements, and the assignment and licensing of patents. Students who successfully complete this class will gain a working understanding of patent litigation practice.
