Appellate Advocacy-Intellectual Property

Catalog description

This course will teach writing an appellate brief to the U.S. Court of Appeals for the Federal Circuit. The problem will involve one patent law issue and one other related intellectual property issue. The problem is designed to teach an aspect of patent litigation beyond basics covered in introductory doctrinal courses by focusing appealable issues on real-world, common litigation issues such as: claim construction, admissibility of experts in IP cases, damages, and the intersection of patents and antitrust law. The goals of the course are to encourage students to think critically about issues and to evaluate complex issues, learn to organize thoughts around those issues, and learn to communicate clearly, conclusively and with credibility in writing and through oral presentation.
