This course explores the dynamic and often contentious relationship between private property rights and public regulation in American land use law. The course covers critical topics including zoning administration, constitutional limitations on land use controls (with special focus on due process and takings), environmental regulations, exclusionary zoning challenges, historic preservation, and growth management. Students will dive into the practical world of land use disputes, learning how local governments regulate property through zoning, how developers and property owners navigate these regulations, and how courts referee these conflicts.Offered by Law.
