Commercial Arbitration: Procedure and Practice. 3 credits

This course is open to all students and is a pre-requisite for the VIS International Moot Court course (Law 127). Arbitration is the preferred method of dispute resolution for sophisticated commercial parties in the fastest-growing sectors of the economy worldwide. This course provides future litigators with the legal foundation and practical skills to hit the ground running, covering the Federal Arbitration Act, enforceable arbitration clauses, arbitrator selection, arbitral procedure, and the enforcement and annulment of awards, both domestically and internationally. The class then operates as a simulated law firm built around the Willem C. Vis International Commercial Arbitration Moot problem. The class will review facts, conduct research, draft a Claimant's Memorandum, and argue before an arbitral tribunal, giving every student real advocacy experience. Selected students enroll in Law 127 in the spring, and travel to Budapest and Vienna to compete.Offered by Law. May not be repeated for credit.
