This course acquaints students with the various problems involved in risk-spreading through private and public insurance. Concepts of risk, uncertainty (or compound risk), and insurability are discussed as well as contractual problems such as mistake, fraud, and coinsurance. The impact of insurance upon the development of tort doctrines such as strict and vicarious liability and relaxed standards of causation are addressed. Government regulation of the insurance industry receives some attention.Offered by Law. May not be repeated for credit.
