Elective Course Course Requirement: written assignments Satisfies the Experiential Learning requirement This course provides a comprehensive survey of common government investigative techniques, with a focus on emerging technology and cyber investigations. Students will study the statutes, procedural rules, and court decisions relating to open-source investigations, court-ordered process (search warrants and Rule 2703(d) orders), and voice and data wiretaps. The course will emphasize investigations involving electronic evidence and emerging technologies, such as e-mails, text messages, social media, facial recognition and tracking of geographic coordinates. Students will explore the relationship between the Fourth Amendment and technology and assess whether new regulatory and statutory protections are necessary to fill any privacy gaps. They will also learn about common grand jury issues and using the grand jury process proactively to advance investigations. Guest speakers will provide case presentations and offer practical advice.
