Catalog description

This course introduces students to basic principles of statutory interpretation and administrative law. The course begins with judicial interpretation of statutes and then course covers separation of powers principles, administrative rulemaking, administrative adjudication, and judicial review of agencies' statutory interpretations. Although no substantive area of law is the sole focus of this statutory elective, the tools students will learn in the course will have wide application in their academic and professional lives. The "Advanced Sack" version of STAT: LEGISLATION & ADMINISTRATIVE REGULATION applies the 1L Sack model to this upper division course, reinforcing core legal analysis skills in part via formative assessment with individualized feedback during the semester. The legal analysis skills taught will include, among other things, synthesizing and distilling legal rules, sophisticated analogical reasoning, identifying legal issues, utilizing relevant facts to support one side or another to analyze legal issues, statutory analysis, and legislative drafting. This course is not a prerequisite for the Legislation Clinic. Prior enrollment in the upper division Legislative Process course is required for the Legislation Clinic.
