Catalog description

The use of alternative dispute resolution has been most extensive in the area of employment law. Mediation and arbitration are widely used not only in the collective bargaining setting, but also in virtually every aspect of the employment relationship. Offers a comprehensive review of the subject with special emphasis on the extensive body of law that has developed in regulating employer-imposed arbitration. Discussion of mediation includes use of simulations to enable the students to understand how mediation can effectively resolve employment disputes. Opportunities to observe real mediations of employment disputes. Experienced attorneys discuss the 'real world' use of employment ADR from a plaintiff's and a defendant's perspective.
